These Terms of Service ("Terms") apply to your access to and use of websites, mobile games, applications, and other software provided by Ember Lore Studios ("Ember Lore Studios," "we," "us," or "our") (collectively, the "Services"). By using a Service, you agree to these Terms. If you do not agree, do not use that Service. Additional terms or notices may apply to particular Services or features; if they conflict with these Terms, the more specific terms control for that Service or feature.
1. Eligibility and Accounts
You must be legally able to enter into these Terms to use a Service. If you are under the age of majority where you live, you may use a Service only with the involvement and consent of a parent or legal guardian, who is responsible for your use. Some Services may have additional age requirements. You agree to provide accurate information when creating an account and to keep your credentials secure. You are responsible for activity under your account and should promptly contact us if you believe it has been accessed without authorization.
2. License to Use the Services
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Services for your own lawful, non-commercial purposes. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from a Service except where applicable law does not allow that restriction or we have given written permission. This license ends when your right to use the Service ends. Third-party and open-source components may be subject to their own license terms.
3. Acceptable Use
You agree not to:

- Interfere with, disrupt, or attempt unauthorized access to a Service, its accounts, or its systems.

4. User Content
You retain any rights you have in content you submit to a Service ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify as needed for technical purposes, and display that content solely to operate, provide, and improve the relevant Service. You represent that you have the rights needed to submit the User Content and grant this license. We may remove content that we reasonably believe violates these Terms or applicable law.
5. Purchases and Subscriptions
Some Services may offer paid features, digital content, or subscriptions. Prices, features, renewal terms, and applicable purchase conditions will be presented before you buy. Purchases made through an app store or other platform are also subject to that provider's terms and payment processes. Cancellation and refund requests may need to be made through the provider, subject to applicable law and the provider's policies. Unless applicable law requires otherwise, digital items and features are licensed for use within the relevant Service, are not transferable, and have no cash value outside the Service.
6. Our Intellectual Property
The Services and their content, including software, designs, text, artwork, audio, names, and logos, are owned by or licensed to Ember Lore Studios and are protected by intellectual-property laws. Except for the limited license in these Terms, we reserve all rights in the Services. You may not use our branding or content without our prior written permission, except as permitted by law.
7. Third-Party Services and Availability
A Service may link to or rely on third-party platforms, stores, or services. We do not control third-party services, and their terms and privacy policies apply to your use of them. We may update, change, suspend, or discontinue all or part of a Service. We do not guarantee that a Service will always be available, compatible with every device, or free from errors.
8. Disclaimers
To the fullest extent permitted by law, the Services are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that a Service will be uninterrupted, secure, or error-free. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
9. Limitation of Liability
To the fullest extent permitted by law, Ember Lore Studios will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of a Service. To the extent liability cannot be excluded, our liability is limited to the amount you paid to us for the relevant Service in the 12 months before the event giving rise to the claim, or, if you paid nothing, 100 US dollars. These limits do not apply where prohibited by law and do not limit liability that cannot legally be limited.
10. Termination
You may stop using a Service at any time and may request account deletion as described in our Account and Data Deletion Instructions. We may suspend or end your access as described in these Terms. Sections that by their nature should continue after termination will survive, including provisions concerning intellectual property, disclaimers, liability, and disputes.
11. Governing Law and Disputes
These Terms are governed by the laws applicable in the jurisdiction where Ember Lore Studios is established, without regard to conflict-of-law rules. Courts with jurisdiction in that location will resolve disputes, except where applicable consumer-protection law gives you the right to bring a claim elsewhere. Nothing in these Terms limits rights that cannot be waived under applicable law.
12. Changes to These Terms
We may update these Terms from time to time. We will revise the effective date above and provide additional notice or obtain consent when required by law. Changes apply from their effective date. If you do not agree to revised Terms, stop using the affected Service.
