Terms of Service

1. Acceptance of Terms & Eligibility

By downloading, installing, accessing, or using VesperZero ("the App"), you enter into a legally binding agreement with Ember Lore Studios, LLC ("Company", "we", "us", or "our") governed by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install, access, or use the App.

You affirm that you are at least 13 years of age (or the minimum legal age of digital consent in your jurisdiction). If you are between the ages of 13 and the legal age of majority where you reside, you represent that your legal guardian has reviewed and agreed to these Terms on your behalf.

2. License Grant & Scope of Use

Subject to your strict compliance with these Terms, Ember Lore Studios, LLC grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and execute VesperZero solely in machine-readable binary form on compatible Android hardware that you own or personally control, solely for personal, non-commercial purposes.

3. User Restrictions

You expressly agree not to, directly or indirectly:

  • Decompile, reverse engineer, disassemble, decrypt, extract, or attempt to derive the underlying source code or algorithmic models of the App, except to the extent specifically permitted under mandatory local law or governing open-source software licenses.
  • Modify, adapt, translate, enhance, or create derivative works based upon the App, its visual presentation, branding, or assets.
  • Rent, lease, lend, sell, distribute, redistribute, sublicense, host, or commercially exploit the App or any digital unlockable items acquired within it.
  • Circumvent, disable, bypass, or tamper with any technological protections, security parameters, digital licensing checks, or Google Play Billing verifications embedded in the App.
  • Use the App for any fraudulent, unlawful, or unauthorized purpose, or in violation of Google Play Developer Distribution policies.

4. In-App Purchases, Billing & Refunds

VesperZero may provide optional in-app purchases, digital visual themes, feature enhancements, or voluntary supporter tiers.

  • Google Play Billing: All payment transactions, subscriptions, and digital item fulfillments are handled exclusively by Google LLC through the Google Play Billing Library. Ember Lore Studios, LLC does not collect, receive, or store your credit card data, bank information, or financial instruments.
  • Pricing and Taxes: Digital item pricing is displayed in local currencies via the Google Play interface and may be updated periodically. Taxes (such as VAT, GST, or local sales tax) are calculated and collected automatically by Google Play in accordance with regional marketplace facilitator legislation.
  • Refund Policy: All digital sales and virtual purchases are final and non-refundable, except as expressly provided under the Google Play Refund Policies or required by applicable statutory consumer protection law. Refund requests should be submitted directly via your Google Play account order history.

5. Launcher Operations, Third-Party Apps & Emergency Dialing

VesperZero functions as an alternative Android user interface and application launcher. By utilizing the App, you acknowledge and agree to the following operational parameters:

  • Installed Application Access: The App uses the QUERY_ALL_PACKAGES permission strictly to display, filter, and execute third-party applications installed on your device. Ember Lore Studios, LLC does not inspect, oversee, operate, or assume liability for any third-party software, website, or service launched via VesperZero.
  • No Emergency Communications Tool: VesperZero is a home screen visual interface, not a telephone service or communications carrier. It relies wholly on your device's cellular hardware and underlying Android operating system to launch telephony applications. Do not rely on VesperZero as a guaranteed or primary tool for emergency calling (such as 911, 112, or local emergency services). In hardware freezes, software exceptions, or low-memory system aborts, access emergency services via your device's physical hardware overrides or native emergency dialers.

6. Privacy & Telemetry Data

Your privacy is fundamental to our development philosophy. Core launcher configurations, application preferences, and local search queries are processed strictly on-device.

To identify crashes, improve application stability, and diagnose performance regressions, VesperZero incorporates Google Firebase Analytics and Crashlytics. By using the App, you acknowledge and agree to the collection of anonymized, non-personally identifiable diagnostic telemetry as set forth in our Privacy Policy.

7. Intellectual Property Rights

The App, including its visual emblem, aesthetic theme, software architecture, user interface elements, graphic designs, icons, documentation, and underlying code, is and remains the sole and exclusive intellectual property of Ember Lore Studios, LLC and its licensors. All rights not explicitly granted to you under Section 2 are reserved by the Company.

8. Modification, Updates & Termination

We reserve the right to periodically release software updates, patches, bug fixes, or enhancements via the Google Play Store, or to discontinue support for legacy Android OS versions without prior liability. These Terms remain in effect until terminated. Your rights under this license terminate immediately without notice if you fail to comply with any provision of these Terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VESPERZERO IS PROVIDED TO YOU STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND DEFECTS. EMBER LORE STUDIOS, LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, SYSTEM INTEGRATION, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL MEET YOUR INDIVIDUAL REQUIREMENTS, THAT ITS OPERATION WILL BE COMPLETELY UNINTERRUPTED OR ERROR-FREE, OR THAT APPLICATION CRASHES WILL NOT OCCUR UNDER UNFORESEEN HARDWARE ENVIRONMENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL EMBER LORE STUDIOS, LLC, ITS MEMBERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, DEVICE OPERATIONAL DOWNTIME, HARDWARE DAMAGE, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS, USE, OR INABILITY TO USE VESPERZERO, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR AGGREGATE TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE TOTAL MONETARY AMOUNT ACTUALLY PAID BY YOU TO EMBER LORE STUDIOS, LLC FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY UNITED STATES DOLLARS ($50.00 USD), WHICHEVER IS LESS.

11. Governing Law & Dispute Resolution

These Terms and any dispute arising from or related to the App shall be governed by and construed in accordance with the laws of the State of Washington, United States, excluding its conflict of law principles.

You agree that any formal legal proceedings or judicial actions arising out of these Terms shall be instituted exclusively in the state or federal courts situated in the State of Washington. You hereby irrevocably submit to personal jurisdiction and venue in such courts and waive any objection regarding inconvenient forums.

YOU AND EMBER LORE STUDIOS, LLC AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE DISPUTES WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR WE WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY.

12. Severability & Entire Agreement

If any provision of these Terms is found to be illegal, void, or unenforceable under applicable law, that provision shall be severed or modified to the minimum extent necessary to make it valid and enforceable, and all remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ember Lore Studios, LLC regarding VesperZero.
